Exemptions to requirement for resold customers to enter into direct terms with Google for Google Cloud Platform, Maps, and SecOps Services

Exemption Categories for Google Cloud Platform and Maps

The following Customer categories are exempt from the requirement to enter into terms of service or any other contract directly with Google for the provision of the Google Cloud Platform Services and Maps Services:

  • Public Sector Customers Globally: Customers who:

(i) are expressly subject to laws or regulations governing the procurement of goods or services by bodies which are publicly funded or controlled by any country, territory, state, or regional or international body; or

(ii) benefit from an express exemption, derogation, or special regime under such laws or regulations, for example due to low value, national security, urgency, single source award rights, or otherwise. 

  • Sovereign Cloud Customers: Customers who, under a billing subaccount with the Partner, have an active order of Sovereign Controls by Partners or Key Access Justifications (KAJ).
  • Regional Exemptions: Customers whose billing address is in the Kingdom of Saudi Arabia (KSA).
  • Open Clouds for Research Environments (OCRE): Customers operating within the Open Clouds for Research Environments (OCRE) framework.
  • Customer-Specific Exemptions: Customers who Google has agreed in writing to exempt from these requirements. 
  • Partner-Specific Exemptions: In certain situations, a Partner may be exempted from these requirements, and thus any Customer purchasing Google Cloud Platform Services via that Partner will be exempt as well. These will be addressed on a case-by-case basis by mutual written agreement of the Partner and Google. Partner must notify its Customers if Partner receives such an exemption from Google.

Exemption Categories for SecOps

The following Customer categories are exempt from the requirement to enter into terms of service or any other contract directly with Google for the provision of the SecOps Services:

  • U.S. Public Sector Customers: Customers that are federal, state, or local government entities of the United States (or representatives of such entities), but excluding any: (i) non-profit entities (as defined under applicable laws, rules, and regulations) and (ii) educational institutions providing legitimate educational or instructional services. 
  • Partner-Licensed Managed Security Services Customers: Customers to whom Partner is providing managed security services where Partner has an active order of SecOps Services with the Partner’s business address as the applicable Service Address.
